- The Seller is obliged to deliver goods free from defects and in conformity with the contract. The Seller is responsible for the quality and conformity of delivered goods with the order. For Consumers (including “entrepreneurs with consumer rights”), the Seller’s liability is governed by the Polish Act on consumer rights and related provisions. For Business Customers, the Seller’s liability is governed by the Polish Civil Code. These Terms do not limit mandatory Consumer rights.

Terms and Conditions of the Beef-Atelier.com Online Store
§1
General provisions
- These terms and conditions (the “Terms”) set out the rules for using the online store beef-atelier.com (the “Store”) operated by BF sp. z o.o., with its registered office in Kraków, ul. Skośna 18, registered in the National Court Register (KRS) under number 000111862, NIP: 6762689569, REGON: 541182657 (the “Seller”). The Store sells meat and animal-origin products via distance selling, within the territory of the Republic of Poland.
- The Seller is registered in Poland. You can contact the Seller via e-mail: shop@beef-atelier.com (electronic correspondence address).
- Using the Store requires a device with Internet access and a web browser that supports JavaScript and cookies, as well as an active e-mail account.
- By browsing the offer and placing an order in the Store, the Customer confirms they have read and accept these Terms. The Terms are available on the Store’s website at all times in a form that allows the Customer to download, save and print them.
- The Store is addressed to both Consumers and Business Customers. The Terms are not intended to limit any mandatory consumer rights under applicable law. In the event of any conflict, mandatory legal provisions shall prevail.
§2
Definitions
- Customer – a natural person with full legal capacity who places or intends to place an order in the Store; the Customer may be either a Consumer or a Business Customer.
- Consumer – a customer who is a consumer within the meaning of Article 22¹ of the Polish Civil Code, i.e. a natural person performing a legal act with an entrepreneur that is not directly related to their business or professional activity. For the purposes of these Terms, a Consumer also includes a natural person concluding a contract directly related to their business activity when it does not have a professional character for that person (so-called “entrepreneur with consumer rights”).
- Business Customer – a customer who is not a Consumer; a natural person, legal person or organisational unit conducting business or professional activity in their own name and placing an order in the Store within that activity.
- Seller – BF sp. z o.o. – the entity operating the Store and concluding sales contracts with Customers.
- Goods / Product – movable goods offered for sale in the Store, in particular meat and animal-origin products, described on the Store pages (each product includes key characteristics such as type of meat, weight, price, use-by date, storage conditions, etc.).
- Sales Contract – a distance sales contract concluded between the Customer and the Seller under these Terms, using electronic means of communication (the Store platform).
- Business Days – Monday to Friday, excluding public holidays in Poland.
§3
Placing orders and concluding the contract
- The Customer may purchase products by registering a user account in the Store or without registration (as a guest). Registration requires providing an e-mail address, setting a password, accepting these Terms and reading the Privacy Policy.
- To place an order, the Customer selects product(s), adds them to the cart and completes the order form. The Customer provides the data necessary to fulfil the order (including name/company name, delivery address in Poland, e-mail address, phone number) and selects delivery and payment methods from the available options. Before final submission, the Customer can review and modify the order and data.
- After completing the order and selecting delivery/payment options, the Customer submits the order by clicking a button such as “Place order and pay” (or equivalent), which constitutes an offer to conclude a Sales Contract. The Customer then receives an automated e-mail confirming receipt of the order and summarising its details.
- The Sales Contract is concluded only when the Seller sends a second e-mail confirming acceptance of the order for fulfilment. This message confirms the final products, price, delivery cost, estimated fulfilment time and a unique order number. Until such confirmation is sent, the Customer’s order is not binding on the parties. The Seller may refuse to accept an order in justified cases, such as product unavailability, an obvious pricing error, or the Customer not meeting the conditions of these Terms, and will promptly inform the Customer.
- Until the Seller accepts the order for fulfilment, the Customer may request changes or cancellation by contacting the Seller (e.g. via e-mail). After the Sales Contract is concluded, changes are possible only with the Seller’s consent.
- The content of the Sales Contract (order details and these Terms) is stored and secured in the Seller’s IT system. The Seller sends confirmation of the contract terms to the Customer’s e-mail address. The Customer may also access order details via their user account (if created).
§4
Prices and payments
- All product prices in the Store are gross prices in Polish zloty (PLN) and include VAT at the applicable rates. Delivery costs are not included in the product price and are shown separately during checkout.
- The final amount payable includes the price of the selected products and the delivery cost. The total order price is shown to the Customer in the order summary before the order is placed. The Seller provides a proof of purchase (receipt or VAT invoice upon request) specifying the product price and delivery cost (if applicable).
- The Seller provides the following payment methods:
- online payment (card payment and other available methods) via integrated payment providers (Stripe – details of currently available payment channels are presented in the Store during checkout),
- traditional bank transfer to the Seller’s bank account (transfer details will be provided after placing the order, in the order acceptance e-mail),
- cash on delivery (if offered by the Seller – availability will be shown during checkout).
- If the Customer chooses prepayment (transfer/card/online payment), payment must be made no later than within 3 days of receiving the order acceptance confirmation. The Seller will process the order after the payment is credited. In the event of delayed payment, the Seller may set an additional deadline and, if ineffective, cancel the order.
- The Seller reserves the right to change product prices and to introduce or withdraw promotions. Orders placed before the effective date of a change are processed on the basis of the prices and conditions applicable at the time of ordering. Information about current promotions is available on the Store website.
- For products sold in specific weight portions, the actual weight of a packed product may slightly differ from the weight declared on the Store page due to the nature of the product and portioning process. The Seller strives to ensure the difference does not exceed ±10%. The final weight and corresponding gross price will be shown on the proof of purchase. If an adjustment is necessary due to the weight difference, the Seller will inform the Customer and settle the difference (overpayment refunded via the same payment method; in case of underpayment, shipment may be conditional upon paying the missing amount).
- The Seller ensures that electronic transactions in the Store are processed via secure and certified payment channels. Payment data (e.g. card numbers) is not stored by the Seller. The Customer should use a secure connection and protect their account and online banking credentials.
§5
Delivery
- Delivery is available only within Poland. The Store does not ship orders outside the territory of the Republic of Poland. The Customer must provide a delivery address located in Poland.
- The Seller delivers orders exclusively via DPD courier service. Products are shipped in packaging designed to maintain the cold chain (insulated packaging with cooling inserts), ensuring appropriate conditions for food transport.
- The estimated fulfilment and delivery time is shown during checkout and in the order acceptance e-mail. Standard delivery time within Poland is typically from 24 hours up to several business days, depending on the delivery address, product availability and the selected shipping option. The Seller strives to dispatch goods promptly after completing the order.
- Delivery costs are borne by the Customer unless a promotion states otherwise (e.g. free delivery above a certain order value). The total delivery cost is shown before placing the order and in the order acceptance confirmation.
- The Seller ensures that shipped products are properly packed and secured for transport in accordance with sanitary requirements. Perishable goods are generally shipped from Monday to Thursday to avoid parcels being held in courier warehouses over the weekend. Couriers typically deliver during business hours (8:00–18:00) — the Customer should ensure someone authorised is available at the delivery address.
- Upon delivery, the Customer (or an authorised person) should check the external condition of the parcel. If there is visible damage or other concerns (e.g. leakage or suspected loss of seal), the Customer is advised to prepare a damage report with the courier and promptly contact the Seller. Failure to do so does not remove statutory rights, but may facilitate claims against the carrier.
- The risk of accidental loss or damage to the Goods passes to the Customer upon delivery of the parcel to the Customer or an authorised person. For Business Customers who arrange their own carrier (not proposed by the Seller), the risk passes when the goods are handed over to that carrier.
§6
Product information and legal compliance
- The Seller declares that all products offered in the Store come from legal sources and verified suppliers. The sold meat is subject to veterinary inspection and approved for consumption in accordance with applicable veterinary and sanitary regulations. The Seller holds any required permits/registrations and processes, stores, packs and ships meat while maintaining the cold chain and proper hygiene to ensure product quality and food safety until delivery.
- The Seller fulfils information obligations under food law, in particular Regulation (EU) No 1169/2011 on the provision of food information to consumers. Before purchase, the Customer receives the required information about each product, such as product name, type, ingredients, allergens, net quantity (weight), special storage conditions (e.g. temperature), use-by/best-before date (where applicable), country/place of origin (where required), producer/distributor name and address.
- Food products are delivered in packaging with labels in Polish containing legally required information. If any information cannot be displayed online (e.g. certain date markings), it will be provided no later than at the time of delivery. In case of discrepancies between the online description and the label on the delivered product, the label information prevails, without prejudice to the Customer’s right to submit a complaint if the delivered goods do not match the order.
- The Customer should be aware that fresh products (especially meat) may naturally vary in appearance (e.g. colour shade, marbling, shape) compared to photos displayed in the Store. Product photos are for illustrative purposes only. Such differences do not constitute grounds for a complaint provided the product matches the order in type, weight, quality and other key characteristics.
§7
Right of withdrawal (returns)
- Under applicable law, a Consumer does not have the right to withdraw from a distance contract in relation to goods that are perishable or have a short shelf life. The legal basis in Poland is Article 38(4) of the Act of 30 May 2014 on consumer rights. Due to the nature and required cold-chain conditions, meat and meat products sold in the Store fall within this category; therefore, after delivery, the Consumer cannot return the order within 14 days due to a change of mind.
- By placing an order, the Consumer acknowledges that the statutory right of withdrawal without cause does not apply due to the nature of the ordered products. The Seller reminds the Consumer of this in these Terms and may also display this information during checkout.
- This limitation applies only to withdrawal without cause. It does not affect the Customer’s right to submit a complaint if the delivered product is defective, not fresh, damaged or otherwise not in conformity with the contract.
- If the Store were to offer products not covered by the exclusion (e.g. long-shelf-life goods), the Consumer would have the right to withdraw within 14 days of taking possession of the goods. However, as a rule, the Store offers fresh, perishable products; therefore, the right of withdrawal is excluded for such products.
- For completeness, if withdrawal were applicable and effective, the contract would be considered not concluded and the parties would return the received performances. As noted, for perishable goods this does not apply due to the statutory exclusion.
- The Seller may provide Consumers with relevant information regarding withdrawal along with the delivery and/or by e-mail, indicating that withdrawal does not apply to specific purchased products due to their nature.

Complaints, non-conformity and quality assurance
- The Seller is obliged to deliver goods free from defects and in conformity with the contract. The Seller is responsible for the quality and conformity of delivered goods with the order.
